Tennessee divorce law concerning relocating children after divorce changed in the late 1990’s. The Supreme Court of Tennessee ruled that a custodial parent could relocate with a child regardless of the objection of the non-custodial parent if the custodial parent had a valid reason to move, the move was not vindictive, and the move was in the best interest of the child. This put Tennessee law in line with most states. The next year, the Legislature enacted a new law, requiring very specific notice and requirements. In relocation cases, details matter.
