Tennessee divorce law concerning relocating children after divorce changed in the late 1990's. The Supreme Court of Tennessee ruled that a custodial parent could relocate with a child regardless of the objection of the non-custodial parent if the custodial parent had a valid reason to move, the move was not vindictive, and the move was in the best interest of the child. This put Tennessee law in line with most states. The next year, the Legislature enacted a new law, requiring very specific notice and requirements. In relocation cases, details matter. The parent considering relocation should read the overview and our selection of cases in which parental relocation has been considered by the Tennessee appellate courts and either granted or denied. Studying the cases reveal some important patterns. For more information, read the following pages and contact Miles Mason Family Law Group, plc.
